Terms of Service

1. Agreement

By accessing or using Pozul, you agree to these Terms and our Privacy Policy. If you use Pozul for a business or organization, you represent that you have authority to bind it. If you do not agree, do not use the service.

2. The service

Pozul provides tools for collecting and monitoring reviews, sending review requests, drafting responses, displaying social proof, analyzing reputation performance, and measuring local visibility. Features may depend on plan, location, connected services, and third-party platform availability.

We may improve, add, remove, or change features. We will use reasonable efforts to give notice of material changes that significantly reduce paid functionality.

3. Accounts, trials, and billing

You must provide accurate information, protect account credentials, and notify us promptly of suspected unauthorized use. You are responsible for activity under your account and for your authorized users.

Paid plans, trials, usage allowances, fees, renewal terms, and taxes are shown at checkout or in an order form. Unless stated otherwise, subscriptions renew automatically until canceled. Fees already paid are nonrefundable except where law requires otherwise or an order form says differently.

4. Customer data and connected services

You retain rights in the information and content you submit. You grant Pozul permission to host, process, transmit, display, and create technical copies of that content as needed to provide and secure the service. You are responsible for having the rights and permissions needed to provide it.

Third-party services—including review platforms, payment processors, email providers, telecommunications providers, and AI providers—have their own terms and may change or discontinue their services. Pozul is not responsible for third-party services outside our control.

5. SMS and messaging terms

Recipient terms

When you opt in to texts from a business using Pozul, you may receive the message categories you selected. Review-request messages may include a request for honest feedback and limited follow-up, not more than 3 messages per transaction. Promotional message frequency varies. Message and data rates may apply. Consent is not a condition of purchase.

Reply STOP to opt out. Reply HELP for help. You may also contact support@pozul.com. Carriers are not liable for delayed or undelivered messages.

Business-customer responsibilities

Business customers may message only recipients who have given valid consent for the specific sender, channel, and message category. Customers must preserve consent evidence, honor opt-outs promptly, identify themselves accurately, follow approved templates and frequency limits, and comply with applicable laws, carrier rules, and platform policies.

Customers may not use purchased, rented, scraped, or shared contact lists; send cold or unsolicited messages; hide the sender; use misleading content; condition a purchase or core service on SMS consent; or use review gating. Review requests must ask for honest feedback and must not selectively route only satisfied customers to public review sites.

6. Acceptable use

You may not use Pozul to violate law or third-party rights; send spam; distribute malware; interfere with security or availability; reverse engineer the service except where law permits; misrepresent identity or affiliation; manipulate reviews; submit fake reviews; or collect, use, or disclose personal information without authorization.

We may investigate suspected violations, limit or suspend access, block messaging, preserve evidence, and cooperate with lawful requests. Where practical, we will give notice and an opportunity to cure.

7. Intellectual property and feedback

Pozul and its licensors own the service, software, designs, documentation, trademarks, and related rights, excluding customer data. We grant you a limited, nonexclusive, nontransferable right to use the service during your subscription. If you provide product feedback, you allow us to use it without restriction or payment.

8. Confidentiality

Each party may receive nonpublic information from the other. The receiving party will use reasonable care to protect it and use it only to perform under these Terms. This duty does not apply to information that is public through no fault of the receiving party, already known lawfully, independently developed, or received lawfully from another source.

9. Disclaimers

To the maximum extent permitted by law, the service is provided “as is” and “as available.” Pozul disclaims implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement. We do not guarantee specific review volume, ratings, search rank, revenue, uninterrupted operation, or continued availability of third-party platforms.

10. Limitation of liability

To the maximum extent permitted by law, neither party will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, or data. Pozul’s total liability arising from the service will not exceed the amount paid to Pozul for the affected service during the 12 months before the event giving rise to the claim. Some jurisdictions do not allow certain exclusions, so portions of this section may not apply.

11. Indemnity

You will defend and indemnify KAVRICO LLC and its personnel from third-party claims arising from your customer data, messaging practices, violation of these Terms, or infringement of third-party rights, except to the extent caused by Pozul.

12. Termination

You may stop using the service at any time and cancel as described in your account or order form. We may suspend or terminate access for material breach, unlawful or harmful use, nonpayment, or risk to the service or others. Provisions that by their nature should survive termination will survive.

13. General terms

These Terms and any order form are the entire agreement about the service and replace earlier understandings on that subject. If a provision is unenforceable, the remaining provisions stay effective. You may not assign these Terms without our consent, except in connection with a merger or sale of substantially all assets. We may assign them in connection with a reorganization or sale.

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law rules. Courts located in New Jersey will have exclusive jurisdiction, except where applicable law requires otherwise.
